Records requested:

1. Evidence provided to the University/OUS that Lessee (Trammell Crow) has secured and closed financing as per condition 1 below.
2. Payments, receipts of payment, or evidence of payment from Lessee to the University/OUS as per condition 2 below.
3. Any other financial transactions between the Lessee and the UO/OUS related to the development, leasing, or financing of properties within the Riverfront Research Park.
4. Documents modifying these conditions (1 and 2, below).

Background:

The Jan 6, 2010 "TC Ground Lease" document (provided in an earlier documents request; attached), includes the following two conditions:

"1. The date by which Lessee must secure and close the Financing in Section 6.9(b) of the Ground Lease shall be the date that is one hundred twenty (1 20) days after the date Lessor provides Lessee with evidence satisfactory to Lessee that the conditional use permit for the Project has been renewed (and all appeal periods have elapsed without appeal) so that the Project may proceed.
2. The date on which the first payment of Base Rent is payable pursuant to Section 3.1 of the Ground Lease shall be the date that is one hundred twenty (120) days after the date Lessor provides Lessee with evidence satisfactory to Lessee that the conditional use permit for the Project has been renewed (and all appeal periods have elapsed without appeal) so that the Project may proceed."
